Terms of Service
Terms for using kamustudio.org and for KAMU STUDIO's custom website, local SEO and monthly plan services.
About these terms
These Terms of Service ("Terms") explain the rules for using kamustudio.org (the "website") and the general terms that apply when you work with KAMU STUDIO ("we", "us" or "our").
KAMU STUDIO designs websites for businesses in Ciudad Juárez, Chihuahua, and El Paso, Texas, and works online with clients across Mexico and the United States. Operator details are in our Legal Notice.
By using the website, you agree to these Terms. If you hire us, your accepted written quote or project agreement also applies. If you do not agree with these Terms, please do not use the website.
Our services
We design and build custom websites for local businesses:
- Custom websites in three packages: Express (3 pages), Business (6 pages) and Pro (12 pages).
- Built from your existing brand. We work with your current logo, colors, photos, menu and wording. We do not redesign logos or rebrand.
- Local SEO and a map on your site, included in every package.
- Monthly plans (Basic and Plus) with hosting, your domain and its renewal, HTTPS, a monthly check of your form and a set amount of changes each month.
We do not guarantee search rankings, map placement, traffic, leads or sales. Search engines and map platforms decide how businesses appear in their results.
Package descriptions on the website are summaries. Your exact deliverables are the ones in your accepted quote or agreement.
Quotes and project agreements
- The website is not an offer. Packages, prices and descriptions are general information and an invitation to contact us. They do not form a contract.
- Requests are non-binding. Sending the "Tell us about your business" form does not create a contract, order, booking or payment obligation for you or for us.
- No online payments. There is no checkout on the website and we do not take payments through it.
- Your written quote or agreement governs. Before any work begins we confirm scope, deliverables, timeline, price and payment terms in writing. If your accepted quote or agreement conflicts with these Terms, the quote or agreement governs for that project.
- Acceptance and validity. Each quote says how it is accepted and how long it is valid.
How a project works
- Discovery call. A 15-minute phone or video call to learn about your business, goals and content.
- Blueprint. We send a sitemap and visual direction for your approval within 48 hours after the call.
- Design and build. We build your site and share a private preview link you can review on your phone.
- Launch. After your approval we connect your domain and publish the site.
- Ongoing care or handover. Customers on a monthly plan receive ongoing care. Customers without one receive the handover in their agreement.
The 48-hour time applies only to the blueprint, not to the finished website. Your project timeline is set in your quote or agreement, and depends on receiving your content, feedback and approvals on time.
- Paused projects: if a project stops while we wait for your content, feedback or approval, the dates move back. Your agreement may say what happens after a long pause.
- Delays outside anyone's control: neither of us is responsible for delays caused by events outside our reasonable control, such as natural disasters, widespread internet or provider outages, or government orders.
Your responsibilities
When you work with us, you agree to:
- Provide your content, feedback and approvals on time.
- Give accurate information about your business and tell us about changes.
- Supply only logos, photos, text and other materials you own or have permission to use.
- Review the private preview and approve the site before launch.
By sending us materials you confirm you have the rights we need to use them on your website. If someone claims that materials you supplied infringe their rights, we may take them off the site while the claim is cleared up, and we will ask for your help resolving it.
- Your own site's legal pages and compliance: you are responsible for your site's legal text, such as its privacy notice, and for the permits and rules of your industry. We place on your site the text you give us.
- How to send materials: by email or a file-sharing link. On the discovery call we tell you which formats work best.
- Copywriting or photo editing: your quote says whether writing, photo editing or content creation is included.
Revisions and change requests
Each package includes 2 rounds of changes. A round is one list of changes you send together.
- Revisions are adjustments within the approved blueprint.
- Change requests are anything outside it, such as more pages or new features.
Extra revisions and change requests are billed separately at $45 per hour and may extend the timeline. We confirm any extra cost in writing before doing the work.
Prices, deposits and taxes
Our published base prices, in US dollars:
| Package | Pages | Price |
|---|---|---|
| Express | 3 | $500 |
| Business | 6 | $1,000 |
| Pro | 12 | $1,800 |
Monthly plans: Basic, $49 per month, and Plus, $99 per month (see "Monthly plans" below).
Your final price is confirmed in your written quote before work begins.
- Taxes: prices do not include taxes. Where taxes apply, they are shown separately on your quote and invoice.
- Third-party costs: email hosting, paid plugins or booking and payment tools are not included. We tell you about them before you commit. Your domain is included (see "Domains, hosting and third-party services" below).
- Currency: we bill in the currency on your quote, US dollars or Mexican pesos. Prices shown in other currencies on the website are estimates using third-party exchange rates and are not the amount you will be invoiced.
- Deposit and payments: 50% of the package price as a deposit to start, and the other 50% the day your site goes live. Work begins once the deposit is paid. Your quote sets out the amounts, due dates and accepted payment methods.
Cancellations and refunds are covered by our Refund & Cancellation Policy.
Monthly plans
Monthly plans are priced in US dollars, plus applicable taxes:
- Basic ($49 per month): hosting, your domain and its renewal, HTTPS, a working form that we check every month, and 1 small change a month of up to 30 minutes.
- Plus ($99 per month): everything in Basic with up to 1 hour of changes a month, 2 posts a month on your Google Business Profile and a monthly visits report.
Changes beyond your plan's monthly time are billed at the extra-changes rate.
Billing and cancellation:
- Billing date, first charge and minimum term: set out in your agreement.
- How to cancel: email [email protected]. Your agreement says how much notice is needed.
- Price changes: we tell you by email before the monthly price changes.
Handover without a monthly plan
The package price pays for building your website and includes your domain (see "Domains, hosting and third-party services" below). It does not include hosting, domain renewals, software, support or updates over time; those come with a monthly plan.
- What is handed over at launch: what your agreement lists, for example files, code or account access. We hand over once the agreed amounts are paid.
- Who hosts the site afterwards: you, with the hosting provider you choose. Your agreement says how we help you publish it there.
- Support after launch: whatever your agreement includes, if any.
- If a monthly plan ends: handover follows your agreement and our Refund & Cancellation Policy.
Ownership and licensing
- Your content stays yours. You keep ownership of the logos, photos, text and other materials you supply. You let us use them only to build, host and maintain your website.
- The website we build: your agreement says who owns the finished site, its design and its code, and when they transfer, including any difference between sites with and without a monthly plan.
- Our tools and know-how: we keep the rights to the code, templates and methods we use across projects in general.
- Third-party components such as fonts, libraries and plugins stay under their own licenses.
- Portfolio: we show your site in our portfolio only with your permission.
Domains, hosting and third-party services
- Your domain is included: every package comes with a standard .com, .net or .org domain at no extra cost. We buy it when your site goes live, registered in your name, and manage it in our Cloudflare account. While you have a monthly plan, the plan covers its renewal. If you ask, or if you cancel your monthly plan, we transfer it to you at no cost, and from then on its renewal is your responsibility.
- Hosting and email accounts: your agreement says in whose name the hosting and email accounts are registered.
Third-party services such as registrars, hosting and email providers, booking tools and Google services have their own terms, privacy policies and fees, which you may need to accept directly. Their changes, outages or price increases are outside our control.
Using this website
Acceptable use. Please do not try to disrupt the website, get around its security or spam protection, send false information or someone else's details through its form, or use automated tools to send requests.
Example websites. Hearth & Harvest, Kara Ceramics and Trazo Architecture, shown in "Selected Work", are fictional concept sites made to show our work. Their buttons and forms are demonstrations: they do not send any data and do not create orders, bookings or payments. Their prices are illustrative.
Currency estimator. The price converter turns our US dollar prices into other currencies using exchange rates from ExchangeRate-API. Rates may not be current and are estimates only.
Sound and motion. The website plays short sound effects and animations. See our Accessibility Statement.
Suspension and termination
- Ending a project: as set out in your agreement and our Refund & Cancellation Policy.
- When we may suspend or end services: for non-payment, or if the site's content is unlawful or infringes someone else's rights. We tell you by email first, unless the law or an emergency prevents it.
- Content we will not build or host: content that is unlawful, misleading, infringes someone else's rights or promotes hate or violence.
- After termination: work done up to that date is paid for, and handover and data deletion follow your agreement and our Refund & Cancellation Policy.
Liability
To the extent permitted by applicable law:
- The website and its content are provided for general information, without warranties.
- We do not guarantee search rankings, traffic, leads or sales.
- Liability cap: our total liability for a project is limited to the fees you paid us for that project.
- Indirect losses: we are not liable for indirect or consequential losses, such as lost profits.
Nothing in these Terms excludes or limits liability that the law does not allow to be excluded or limited.
Governing law, disputes and your rights
- Governing law: the law named in your project agreement.
- Disputes: please contact us first so we can try to resolve it.
Nothing in these Terms limits rights you have that cannot be waived under the law that applies to you, including consumer protection law where it applies (for example Mexico's Federal Consumer Protection Law, where you contract as a consumer).
Changes and contact
We may update these Terms. The date at the top of this page shows when they last changed.
